  1. What Information We collect
    Information you provide.

    When you create an account, we ask for registration information including your full name, email address, password and payment method details.

    For purposes of this privacy policies, if you use Tutto Massimo to post jobs, you are a "Restaurant." If you use Tutto Massimo to apply for jobs, you are a "Server."

    To enable our Services, we also ask for limited demographic information, including your first name, gender, resume, job experience, country and zip code. Providing some of this information, including resume and job experience, is optional. We also allow you to upload a photo of yourself and select your level of trainingPlease note that this photo will be seen by users of the site and the companies in which you have submitted your application.  You may remove your photo at any time by accessing the settings page.

    Data we collect. In addition to the information you provide to us, when you use Tutto Massimo, we may also automatically collect and store information about the computer, mobile device, or other devices you use to access Tutto Massimo and about how you use Tutto Massimo. For example, we collect and store data about the courses and quizzes you take and your performance on those quizzes. We may also collect and store information such as your browser type, IP address, language, operating system, unique device identifier, the date and time of your visit, and the pages you view.

    Our use of cookies. To collect information, we use cookies and other standard web technologies (e.g., pixel tags). Cookies are small text files placed on the browser of your computer or mobile device when you visit a website that collect non-personal information. We use “persistent cookies” to save your login information for future logins to Tutto Massimo. We use “session ID cookies” to enable certain features of Tutto Massimo, to better understand how you interact with the Service and to monitor aggregate usage and web traffic routing on the Service. Most browsers automatically accept cookies, but allow you to disable cookies through the “options” or “preferences” menu of your browser. Please be aware that disabling cookies could interfere with the functionality of Tutto Massimo.

    The third-party advertising and analytics companies with whom we or our advertisers partner may place a unique cookie or utilize similar technologies on your browser in order to collect non-personal information about your visits to Tutto Massimo. Their use of this information is governed by their privacy policy.

  2. How We Use Your Information at Tutto Massimo
    We use the information we collect to operate and provide you with Tutto Massimo. This includes, but is not limited to:

    • Authenticating your login and processing your payments;

    • Creating your account, allowing you to add candidates and other users, to operate, maintain, and provide to you the features and functionality of the Service and manage who is able to access the Service, view resumes, view posted jobs, view archived jobs, create a new job, view the public profile to determine who may be the right fit as a candidate for the positions you have open, and contact you in response to your inquiries;

    • Personalizing your Tutto Massimo experience and customizing your training program;

    • Allowing you to monitor your performance and progress in Tutto Massimo, by presenting the results of your quizzes, completion of the courses, and eligibility for a Tutto Massimo course completion certification (you understand that such certification is for marketing purposes only and does not satisfy any Federal, State or local certification regulations);

    • Customizing and delivering information about our products and services by email;

    • Allowing you to invite friends to register for the Service;

    • Providing customer service and sending confirmations about your account; and

    • Protecting our intellectual property or other rights.

    • We reserve the right to email you to confirm transactions or to address account issues (such as when you make a purchase, or you request a reset password) or send notices relating to the website’s functionality.

  3. No Disclosure to Third Parties for Their Own Marketing Purposes
    We believe in protecting your privacy, and therefore do not provide your personal information to third parties for their marketing or promotional purposes.

  4. When We Share Your Personal Information with Third Parties
    We may share your personal information in the following ways:

    • Service providers and agents.
      We may share your information with certain third parties selected by us to help support our operations. These include, for example, services that help us process payments, analyze web traffic, send emails, and track customer service requests. In addition, we may share limited personal information to third parties that help us market or advertise Tutto Massimo. These third parties may have access to your information only for purposes of performing these tasks on our behalf and we contractually require them to protect your information consistent with this Privacy Policy.

    • Affiliates. 
      We may share your information with our corporate affiliates, such as entities under common ownership or control.

    • Business transfers. 
      We may sell, transfer, or otherwise share some or all of our assets in connection with a merger, reorganization, business transaction, or in the event of bankruptcy. In such scenarios, your information may be one of the assets transferred. We will post a notice or otherwise notify you before the information is transferred and becomes subject to a different privacy policy.

    • Compliance with law and law enforcement requests, and protection of our rights. 
      We may disclose your information when we have a good faith belief we are required to do so by law, or in response to a subpoena, court order, or other legal mechanism. We may also disclose your information when we have a good faith belief that disclosure may prevent fraud and abuse of Tutto Massimo or its users or protect our property rights.

    • Consent. 
      We may disclose your information when we believe we have your consent to do so, such as when you contact customer service and ask us about your account, or when we have the consent of someone we believe is authorized to consent on behalf of you, such as the individual associated with the payment method for your account. If you have expressly agreed to participate in a research study with us or with a third party that incorporates your personal information collected by Tutto Massimo, we also may disclose your information for the purpose of facilitating the research to which you have consented. 

  5. Accessing, Reviewing, and Deleting Your Information
    You can access, review and correct the registration and demographic information we have collected about you by logging into your account and navigating to the Account page. Additionally, Servers can use their ID numbers to view their public profiles and manage their public profile privacy settings (the latter applicable only with an active paid membership). You may also access or delete the information all of the information we have collected about you by contacting us at the contact information listed below. While we will make reasonable efforts to accommodate your requests, if allowed by applicable laws, we reserve the right to impose certain requirements and restrictions on such requests, such as limiting our production of information to certain formats.

  6. Security of Personal Information

    We have implemented and maintain reasonable security practices to protect against the unauthorized access, use, modification, destruction or disclosure of your personal information. For example, we use one or more of SSL encryption, firewalls, and anti-virus software. However, no method of transmission or storage is completely secure, and we therefore cannot guarantee absolute security.

  7. Customer Testimonials
    We post customer testimonials on our Web site which may contain personally identifiable information. We do obtain the customer’s consent via email prior to posting the testimonial to post their name along with their testimonial.

  8. Dashboard
    Our Web site offers publicly accessible blogs or community forums. You should be aware that any information you provide in these areas may be read, collected, and used by others who access them. Also, Restaurants have the ability to add Servers to their dashboard, and send automatic email notifications to said Servers inviting them to the course. If the course invitation is accepted, then the restaurant will have access to the Server’s course progress information. Additionally, Restaurants on the master dashboard have the ability to add more locations (hereinafter referred to as the “Sub-Locations”) and have access to Server statuses in all Sub-Locations (whereas each Sub-Location has access only to Servers associated with that Sub-Location).

  9. Links to Other Web Sites
    We are not responsible for the practices employed by websites linked to or from the Service, nor the information or content contained therein. Please remember that when you use a link to go from the Service to another website, our Privacy Policy is no longer in effect. Your browsing and interaction on any other website, including those that have a link on our website, is subject to that website's own rules and policies. Please read over those rules and policies before proceeding.

  10. Use of Services by Minors
    The Services are not directed to individuals under the age of 18 and we request that these individuals do not provide Personal Information through the Services.

  11. Cross-Border Transfer
    The Services are controlled and operated by us from the United States, and are not intended to subject us to the laws or jurisdiction of any state, country or territory other than that of the United States. Your Personal Information may be stored and processed in any country where we have facilities or in which we engage service providers, and by using the Services you consent to the transfer of information to countries outside of your country of residence, including the United States, which may have different data protection rules than those of your country.

  12. Sensitive Information
    We ask that you not send us, and you not disclose, any sensitive Personal Information (e.g., social security numbers, information related to racial or ethnic origin, political opinions, religion or other beliefs, health, criminal background or trade union membership) on or through the Services or otherwise to us. 

  13. Change Policy
    This Privacy Policy may be updated from time to time. If we make material changes, we will provide advance notice to you either by email, by posting a notification on Tutto Massimo or by posting an updated TOS on Tutto Massimo 45 days in advance of the effective date of the updated TOS. Please note that, for existing users, unless otherwise provided by applicable law, your continued use of Tutto Massimo following the effective date means that you agree with, and consent to be bound by, the updated TOS.
